Q: Does court supervision for a 2nd speeding ticket that occurred during first supervision period make sense?

A: Hello Asker,

It is entirely possible to be placed on court supervision for a second ticket that was picked up during the supervision period of a prior ticket. With that being said, there are a couple of caveats. First, the courts do not routinely grant supervision requests without a court appearance if you have had a prior ticket in the last 12 months. Therefore, on this new ticket you are very likely to need to appear in court in order for them to grant you court supervision. Second, assuming that you are eligible on this new speeding ticket, there is no right to court supervision but they do have the power to grant it. Whether your new ticket is a type eligible for court supervision is a question best answered by an attorney. Third and most importantly, because you picked up this new ticket during your supervision period, they can potentially revoke your supervision on the older ticket thus resulting in a conviction. Steps may be necessary to help prevent this from happening.
