Q: The girl that my ex Husband left me for has lost custody of her kids, am I able to keep her away from my son?

We have 50/50 custody. She lost custody for being unstable and only has visitation. Her son is now in therapy. I want to protect my son. She tells her son to tell people that his father hits him. She has had 38 addresses in 36 years. Her son was late or absent to school 30 times or so last year on shared custody. She and her daughter have been in mental institutions. The list goes on. She was a stripper in NY. She has filed false pfas, all dismissed. I have messages from her mother and daughter saying that this is her pattern, she stays 9 months until the money is gone and then leaves. She is a true honest to god con artist. She has made her living taking money from men. I have all of the court documents showing the custody battles of both children. They gave custody to the girls father after he got out of jail on a drug offense. Both fathers at one point got emer custody. I need to protect my boy. How can she lose custody but still be around my son? This is in PA.

The fact that she lost custody of her children in NY doesn't necessarily make her a danger to your son but someone would really to review all of the documentation you've gathered to give you a well-reasoned answer.

A: I agree with Ms. Hilbush but write separately to emphasize the importance of consultation with a good local attorney. Your factual recitation is confusing to say the least. If the child is yours then there may be options. Mental instability in and of itself is not good enough to get an emergency petition, however, if you are truly in fear for your sons safety than you need to talk to someone local ASAP. They will best know how the local courts treat cases like yours and whether or not your remedy even lies in a local court.
