East Stroudsburg, PA asked in Family Law for Pennsylvania

Q: Is my husband required to provide spousal support?

We have been married for 14yrs. We're not officially separated, but by husband lives in NJ with his gf, while I live in our house in PA. The house is in his name only. I have been unemployed for several years. My husband pays the mortgage and utilities. We had a fire at the house and 99% of the stuff destroyed were my personal items. He has given me a fraction of the insurance money and is keeping most of it for himself after reassuring me I would get every penny that was mine. The house is also in horrible condition, because he won't get involved with contractors and doesn't care. He also won't replace appliances like washer/dryer. I have no vehicle and am unable to even get to a laundromat. Do I have a right to spousal support and/or can he be made to improve my living condition to the way they were before the fire? He has a full time job and also works part time at another job. I receive my health insurance through him and was hoping there is a way to prevent him from removing me.

A: You can file for spousal support. Spousal support refers to a request for support when there is not a divorce complaint filed by either party. The court will take your incomes into consideration when calculating a support obligation. I would recommend filing as soon as possible as support payments are only retroactive to the date of filing.
