Q: If I get convicted with a DUI, will I have automatic jail time or is there a way to negotiate to just pay a fine?

A: If this is your first DUI and there was no injury accident, no other serious criminal behavior (punching the cop or something along those lines) and not a taking off from the police, you will probably not get jail in Sangamon County. But you will lose your license for a minimum of one year and at some point have to face the Secretary of State. So there is a lot more at stake than just jail time.

A: It isn't automatic jail time - is discretion of the court, but it depends on a lot of factors like whether this is your first time DUI or whether this is a multiple and whether there was an accident and people were hurt.
