Asked in Immigration Law for New York

Q: What’s the best way to proceed in this situation?

Im a nurse. Have my green card and SSCard. Signed a job offer with an Hospital trough a recruitment agency who sponsor my VISA and instructed by them, resigned my permanent contract to move to the States. Now the hospital with whom I signed is not hiring so I’ve been told I need to take another job offer. So far nothing came up in a State of my choice. I’m without job and they can’t give me a time frame on how long it will take to find out something in a State of my choice. My question: is there something I can do as they’re not keeping their word cause the offer I signed is no longer available or as long they are offering me a job (even if it’s in a State I don’t want to work) there’s nothing I can do? They keep saying they’ll find me something in a state of my choice but they don’t know how long it will take. I’m a bit desperate as leaving the agency requires me to pay a big sum of money.

A: If they aren't meeting their obligations pursuant to an employment contract, hire an employment lawyer to handle it. If you are concerned about your green card, hire an immigration lawyer to help you figure out your options. If you have a green card and an SSN card, you should be fine without employment (i.e. not deportable) unless you have an employment based green card.
