Q: Cited for striking fixed objects (code:40-6-272) in ATL. A lawyer said it's a mischarge as I did not leave the scene.

I did not leave the scene. I pulled over immediately and called the police to fill out an accident report. Is this lawyer friend correct that I was mischarged. I'd just like a second opinion.

A: Ga.Stat. provides

The driver of any vehicle involved in an accident resulting only in damage to a fixture legally upon or adjacent to a highway shall take reasonable steps to locate and notify the owner or person in charge of such property of such fact and of his name and address and of the registration number of the vehicle he is driving and shall, upon request and if available, exhibit his operator's license.

Not sure why you were cited for this. Doesn't seem applicable based upon the facts you have given.
