Q: Uncontested divorce. I originally agreed to not move out of city. I now want to move 1 county away, Can I?

We are have already removed 1 of our original stipulations. I have remarried and my husband has a home 1 county away. We are currently renting our house in the city, and now we are taking on the mortgage at his previous home, now that the renters are moving out. Can my ex make me stay in the city? It seems wrong that he can still control my life. Our 15yr old stays at whichever home she chooses and he has the extra day of official custody. My moving would not change her school location and she would still stay at whicheer home she wants. I currently and would continue to take her to school everyday. Can he make me stay in the same city as him. As a side note there are places in the city that are more than 20 min away so the arguement that its too far doesn't fly since there are parts of the city that are 30 min away.

A: You should consult your divorce paperwork, specifically the "parenting plan order" - there is specific provision about parental relocation near the end of the parenting plan order. It tells you what you must do in order to relocate, and generally if its under 50 miles, you can move without any restrictions ( you can determine the distance on google maps or any other similar tools). The key is mileage, not the minutes it take to travel there.

There is no substitute for knowing the terms of your parenting plan- its court order which MUST be followed, as otherwise you could be held in contempt of court. If you can't make sense of it, consult an experienced family law attorney.
