Q: What to do when Parenting Coordinator won't follow/enforce parenting agreement/custody order?
I was awarded joint custody of my 12 year old son in December. Parenting agreement says we'd work our way to 50/50 parenting time with help of reunification therapist. I have full authority for medical/education but mother isn't cooperating with therapy/school/reunification therapy. Parenting time coordinator is encouraging mother to act in defiance of our custody order. Mother is now wanting to refile for full physical/legal custody even though previous agreements in parenting plan haven't been implemented.
I feel there are strong parental alienation issues at play but can't find professionals familiar with parental alienation.
A: Stop talking about parental alienation. Legally what you have is a joint custody agreement and it isn't working . What the Oregon Courts do, when joint custody by voluntary agreement between the parents doesn't work, is the courts will dissolve the joint custody arrangement and decide which parent has custody and will set parenting time for the non-custodial parent. Regardless of whether you end up with custody or not, you will have a set plan that defines what time you have with your son. If the mother interferes with your time as spelled out in the parenting time plan you can file a motion with the court to enforce your parenting time plan. So be patient, go back to court, and work on getting a parenting time plan that no longer require you and the mother to work together or agree to anything - that obviously won't work.
