Q: I have a son with a girl who was my fiance, but we never married. Can I keep my son legally?
We have separated at her request and we now live apart. She took my son and was giving him to me on weekends and whenever I had a day off. The last time she brought him down I told her I wanted to see him more and have been keep him here with me. Can I legally do this?
A: Unless and until there are court orders in place, each parent has the right to possession of the child. If you can not reach an agreement on parenting time, you can file an action for Parental Responsibility and request the court determine a parenting schedule. The court will also enter orders for child support depending on the respective incomes of the parties. You should retain an attorney to assist you in this matter.
