Q: In Florida, can another driver sue me after an accident if there were no injuries, and he had insurance, while I didn't?
I got a ticket for careless driving in the accident, but there were no injuries and this is a no-fault state, which means he has to fix his car with his own insurance. So if he were to sue me, what would my defense be?
A:
Sorry. “No fault” does not mean he can’t sue you. Also just because there were no apparent injuries at the scene does not mean that an injury did not occur. If you did not have insurance is also another issue. You need to consult with an attorney in your area if the other person does file suit.
Good luck.
A: You can plead not guilty to the careless for one and save yourself some points by getting an attorney that handles tickets. I assume you notified your insurance. If he sues you your insruance wil take care of it, they will claim some defenses to the crash and claim the other person wasn't injured, and if they were they weren't hurt as badly as they say they are, but as no one has sued you yet, you have insurance, you should focus on getting the careless driving charge reduced.
