Q: I have filed for a divorce from my wife. She says she will not answer the summons in the allotted 30 days. What now?
A:
You have to wait until the 30 days expire ( she could be lying to you or she could change her mind about answering ). If no answer is timely filed, you can file a motion ( a written request) to have the Judge grant you a "default judgment." After the default judgment is signed, you will still need to have a final hearing before the Judge where you need to be prepared to prove the grounds for divorce and explain how you want to divide your property. ( I assume there are no children of this marriage, but if so, you will also need to have a parenting plan).
I strongly suggest you consult an experienced divorce lawyer to assist you, failure to get things right now can cause huge problems in the future.
