Asked in Child Custody and Family Law for Colorado

Q: How do you file for child abandonment in Colorado if the father has not seen a child in at least 6 months.

I live in Jefferson County CO, I am looking into filing child abandonment paperwork but I cant seem to find out how ANYWHERE! It has been over 6 months since the father of my child has seen his child and he has made no attempt to make future plans to visit or come see his son. Any inquiries into the well being of our son are simple " how's my son doing" with no response back after I answer. Seemingly only making token efforts to support and communicate regarding the child.

I petitioned for child support so he does pay that, but he has been in arrears since the first payment and has no intention of paying that to bring him current (I asked he says he has more important things to focus on).

We have never been married and there is no custody order in place, but I plan on filing for full decision making with custody.

Plainly how can I start this process, is there filing fees, what grounds are cause for getting emergency custody?

A: Unfortunately, there is no such thing an an "abandonment" or "child abandonment" case you can file. You can certainly take steps tied into his arrears.
