A: No, it's not automatic. He'd have to file for custody through the court. That having been said, provided the court determines that he's not a danger to your child, he may be awarded custodial rights. Depending on how long it's been since she's seen him, the court may order what is called reunification therapy first. If he does file, it would be a good idea for you to at least consult with an experienced family law attorney in your area.
