Q: Wanna sue for money borrowed in middle of 2013 for moving help in nyc

Sister borrowed $4k for help moving and i loaned her on promise she would pay when on her feet. Ive asked several times over years only getting excuses everytime. This year an irreperable rift has come between us and the repair of the relationship is highly unlikely. It is about the money as its been 4 years she has since finished college and can repay. I would have filed years ago but she was my sister and I trusted her. I would like to know if i can sue in nyc for the 4k and if not if there is any motion i can file that would allow me to file due to the circumstances and me trying to do good for my sister. I need the money and she legitimately owes the debt,

I have teller receipt from the withdrawal and witness the heard and witness the transaction

I have no written agreement so what type of evidence can i gather to substantiate this as she will lie and claim she didn't receive i know because she thinks there is no proof. if i secretly recorded her/anyone admitting could i use
