Q: If my daughters father comes in and out of her life for monts at a time & pays no CS. Can he legally take her from me?

He calls or text every few months. When he does he is rude and makes threats. My daughter doesnt have a relationship with him because he is very inconsistent. I don't do drugs. I have a stable home. A degree. Nothing on my background and he is the complete opposite. He keeps saying a highly paid lawyer will have her taken from me since i dont let her leave with him. He doesnt have visitation per last court date. And hasnt paid any child support in almost 3 years. She will be 4 in March. What grounds would any lawyer be able to take her from me and give to him? And do i HAVE to answer his calls and text?

A: I can't think of any, but it would be impossible to say without knowing all of the facts. It sounds like his is just trying to be a bully and is blowing smoke. If you are worried though, I recommend that you consult a lawyer.
