Q: My ex-husband took our childrens' cell phones away from them, that I pay for.

I don't have a landline, and as our girls are 12 & 14 years old, they are often home alone. And, they walk to and from school. Is he breaking any laws? We have asked for the phones back, numerous times, he will not give them back. I feel there's a safety issue here and essentially the phones are mine. Possibly theft? Or in case of emergency, they don't have access to call for help? We live in CO

A: This is more of a criminal law question than a family law question. You should call the police to see if it is a crime. If the phones are yours it may be. If you need orders in your family law case regarding the phones you should consult with an attorney.
