Cranford, NJ asked in Child Custody and Child Support for New Jersey

Q: Can I get custody of my kids if the mother works, but I currently do not, even though I was the primary caregiver?

We were all supposed to move but She moved with them without me,the breakup was a result of this and left me behind,I took care of my kids 90% of the time since birth(6 and 4) while she pursued her career,I've sacrificed jobs and my own income by her request in order for our kids to be taken care of, we were in a financial hole by her mishandling of funds, including withholding debt, late rent ,and using her income at a time where we were border line facing eviction (proof of this) to go on vacations on her own on 2 recent, separate occassions ,she has been unfaithful and sacrificing personal time with her kids to pursue relationships while with me and after multiple breal ups,we have moved at least 8 times since my oldest was born, and once again she moved them, this time without my prior knowledge that this was the plan, she acts before thinking, she shows inconsistency, and I have enough testimonials from friends family and former landlords to back up my claims, what are my rights?

A: Thank you for your question. I am sorry you are going through such a worrying and difficult time. The short answer is ‘yes,' you can see your children and you could get custody or parenting time. There are many different custody options -- including joint legal custody, sole legal and physical custody, and shared legal and physical custody. Your lawyer can help you negotiate the best custody arrangement for your situation.

Depending upon the custody / parenting time arrangements, you could apply for child support payments. Additionally, again dependent upon your individual circumstances, you could be entitled to alimony, too, and this is worth exploring with your attorney. I strongly suggest you speak to a child custody lawyer at your earliest convenience so that you can explain your situation further and explore your options and next steps. Many family law firms offer a free initial consultation to help you understand your rights.

Kind regards,
