Q: not married to the father I moved to Tennessee 11months ago now the father wants to file full custody in FL can he?
He hasn’t seen our kids he hasn’t sent any money I moved to Tennessee 11 almost 12 months ago he sent a picture of papers where he’s going to file in FL so I have to move back to Florida can he do this aren’t my kids Tennessee residents now? Our kids were born in FL we are not and never been married there isn’t any custody paper or agreement in place he isn’t on child support. Please help I moved to Tennessee to get away he stalks me that’s why I moved 11months ago
A: Can he, yes, if FL lets him file the petition. Will he succeed? I doubt it. In TN, you are the sole custodian of the children since you were never married. The children are residents of TN. TN courts have jurisdiction since they have been here for 6 months. You may want to consider filing an order of protection against him and include the children.
