Q: Can I get in trouble if I don't take my son back to his dad,who has temp emergency custody. He want give him back

I went to jail for 6months that's how he got emergency custody and I have now been out for 4months. I've always had our son and my sons father says he will give him back but he just keeps putting me off..I get my son every wkend and now I don't wanna take him back and he don't won't to go back.My son is 12..If I keep him will I get in trouble for not taking him back home.

A: Yes, you will get in trouble if you don't take him back. You need to do this the right way. You need to file in court to get him back. If the father agrees, that will help. Otherwise, you will need to be able to show the court that you are not going to end up back in jail and are capable of caring for your son. You need a lawyer to help you do this. Many will work with you on a payment plan.
