A: Illinois WC benefits are among the best in the Country. It is unlikely that you will find one attorney who is familiar with both state's WC laws. I quick check yields the finding that the maximum weekly compensation in Virginia is $1,043 while the maximum in Illinois is $1,085, with no maximum number of weeks. That said, you would have to be earning $1,627.50 per week to qualify for the $1,085 rate.

Given that you live in IL and that the benefit rates are slightly higher, you are better off filing in Illinois. If it is already filed in VA, it can be changed. We are pleased to answer any questions you may have without cost or obligation. Please call us at 312-465-2914.
