Q: Can someone that is not related to me have my custody?

I am 16 years old.

A: This is very strange because the email related to this post stated: "If my mom leaves in Honduras, and my brother and I live in the US with our custodial dad, and we are been domestic abuse. And our dad has our custody and goes to jail. Where does my brother and I go to?. Can someone else that is not related to us get our custody?" but this info isn't showing up in the post on line.

Your mother is still your legal mother. Even if she isn't in the United States she can consent to someone else taking care of you here in the United States. They can be a baby sitter or a guardian. As long as there is an adult who is legall responsible for you care the children's services don't need to be involved. However if no one is appointed by your mother to take care of you the State of Oregon will step in and place you in foster care until they figure out what the best solution is.

Who ever is offering to care for you, with your mom and dad's permission, can contact an attorney. There is a very simple form that your parents can sign that will give this adult care giver the right to enroll you in school and get medical treatment for you if necessary. Tell that person to consult with an Oregon Lawyer.
