Q: what should we do if we received money from a deceased relative after we went before the trustee
we had no idea we were getting this money
A: If you become entitled to receive an inheritance within 180 days of the bankruptcy filing, that becomes property of the bankruptcy estate and belongs to the trustee for payment to your creditors in a chapter 7 bankruptcy case. You count the 180 days from the date the petition was filled. You should contact your lawyer and inform them of what has occurred to avoid any problems with your case. If you do not have a lawyer you should contact the trustee in your case and tell them. Failure to disclose property of the estate can result in denial of the discharge of your debts so this is a serious matter to the court. If you do not have an attorney you may wish to consult someone in your area for an opinion on how this is handled in your particular bankruptcy court.Hope it works out. Good luck!
