East Stroudsburg, PA asked in Adoption, Child Custody, Child Support and Family Law for Pennsylvania

Q: My child’s father isn’t involved. He shows no interest. Can i have my husband adopt her without his permission?

In the four years my daughter has been alive her biological father was never involved besides minimal visits, lack of phone calls, no child support, and shows no interest. He is not on the birth certificate.

A: If all is as you say, then you should be able to successfully terminate the father's parental rights involuntarily and have your husband adopt her as her stepparent. It's not an easy process and, in fact, some counties won't deal with involuntary terminations of parental rights without an attorney being involved so I suggest that you retain a local attorney experienced in adoptions.
