Memphis, TN asked in Family Law and Child Custody for Tennessee

Q: I was letting him see her when he wanted but 3 recent times he doesn’t return her for hours or days. I’m scared of him.

Baby is 2, we were never married. I was allowing him to get her, but 1 time he kept her through Christmas until 2days later and told me I could have her when he was ready. 2 other times he kept her for several extra hours and would not return my calls. He has threatened to take her and move back to Ohio. I’m scared of him and afraid a restraining order will make him go crazier. What do I need to do, please? He has NEVER given me money for her, and he’s gotten worse since I filed child support papers. Do I have to let him call or see her?

A: If the court has not ordered visitation, then you do not have to let him see her. Child support orders do not normally address visitation or custody. If you are worried about your safety and hers, then you should get an order of protection. If it makes him go crazy, he will go to jail. You should consult attorney to help you through this process.
