Memphis, TN asked in Car Accidents for Tennessee

Q: If I need to sue a person and have no information concerning his address, how would I go about doing that?

I am the victim of a rear-end car accident. The person who rear-ended my vehicle along with his insurance company will not take responsibility for the damages. I was not injured.

A: You have ID of the person presumably from the crash--his insurance responded? Were no police called? Did he not give you his license? I'm asking because the way to get the information is to get a subpoena issued to their insurance. But to do that you have to file suit, and it gets messy.

However you need to confirm why the insurance isn't paying. Most states require that property damage--damage to the vehicle--be resolved in 30 days. Assume you have two estimates and sent them. Then assuming damage is to back of your car, front of his, you send that information to their company certified return receipt.

If you've already done this and it's more than 30 days you file a complaint with the Insurance commissioner's office.
