Q: While I was sleeping my roommate took my car without my permission. She had my 9 y/o with her. She has no license.

She was in a collision & totaled my car & caused extensive damage to a tractor trailer. Then left the scene. I found out after my roommate dropped off my child woke me crying. I called the police immediately. I have full coverage insurance. Am I going to be held liable? Will my insurance cover this?

A: There is a presumption in Tennessee that if someone is driving your car they have permission. You can rebut that presumption by proof the person did not have permission. Make sure to notify your insurer. Tell them all of the facts.

A: Insurance may not cover as she was hijacking your car (and your kid). If you were to be sued however they would cover YOU. At this point don't give statements to any attorney or other insurance--refer them to your insurance.
