All of his rights in the state of Georgia? He has also been to jail for Battery charges against my father at the child’s home. Will a judge most likely take his full rights away due to the fact that he hasn’t been in my child’s life going on 4 years and my son is 4? He also may have a mental disorder. Wanting to remove all rights and I want a divorce!!
A: Getting a divorce is easy. Getting primary physical custody is also likely very easy. Removing rights is not. He's not likely done enough to remove his rights, and he will likely still get some visitation in the divorce. Talk to an attorney about filing for divorce and hit him for some child support.

The last thing you want is an unreasonable attorney that makes a bad situation worse and gives you unreasonable expectations of the outcome. In sum, don't make a bad situation worse. Sounds like he will receive some visitation and parental rights though. Getting in, getting out and getting on with your life will likely depend on what you expect and need of him financially.
