Knoxville, TN asked in Family Law and Child Custody for Tennessee

Q: Ex works abroad 1-2 weeks a month. Says his new GF will babysit on "his days" when he's away. Can i refuse this?

I am primary parent and we share time 50-50. We have a clause in our parenting plan: no overnight houseguests of the opposite sex unless dating for a year or engaged to be married. He has already broken this with her but is lying about it and I have no definitive way to prove this either.

A: If his work schedule is new, it might qualify as a material change in circumstance to allow a modification of the parenting plan. I try to include a "first right of refusal" in all of the parenting plans I draft. This allows a parent the right to keep the child if the other parent is unavailable. I recommend consulting an attorney to evaluate the facts and discuss your legal options with you.
