Q: Can my husband be ordered to pay for a lawyer for me for our contested Divorce / Custody case.
Husband left us Nov 28th and hired a lawyer the next day to file for divorce. Our son and I still reside in the home which he is still making the mortgage and utility payments on. However that very same day he closed the bank and chaged all the passwords to anything financial. Of course everything is in his name due to his Narcissistic tendencies (no diagnosis but hes textbook) . I am without income or money because I am disabled and could never get benefits due to his income. I am even more damaged emotionally from 13 years of his abuse. Depression SEVERE anxiety and waiting for testing for PTSD. I have been doing my paperwork myself and hes taking advantage of that and EVERY one of his motions are nothing but blatant lies to which he will not be able to prove for that reason. He has now filed for Temporary Custody and we go Tuesday. I don't feel he should be able to get away with all that and im left with no way to hire a lawyer. Im denying the stipulated custody order.
A: The judge can order your ex to reimburse you for your attorney bills, but that is usually at the end of an action and it not guaranteed. You may want to ask for temporary maintenance at your next court appearance so that you can afford an attorney to assist you.
