Malden, MA asked in Business Law and Contracts for Wisconsin

Q: Customer wants his cash deposit back after 1.5 years

I used to own a shop doing custom automotive paint. A year and a half ago, a customer made $1,000 cash deposit... and then got sent to prison for stalking and violating his parole. He obviously missed his appointment date, no reply to any of my calls or texts. I had already ordered his materials with his deposit, and set it aside, waiting for him. No contact with him for a year-and-a-half.

After 1y I closed my business and moved out east. His product was used on another vehicle around the one-year mark of no contact.

He got out of prison this week apparently and called me demanding that I refund his thousand dollars or send him his materials, or he would take me to small claims court.

1k isn't a huge deal, but I obviously would rather not have to give it back. No contract was signed of any kind.
