Asked in Family Law, Child Custody and Child Support for Tennessee

Q: Can I have my ex-husband's visitation suspended for non payment of child support?

My ex-husband and I split in Dec. 2016 and our divorce was final July 10, 2017. We have a son that is now 20 months old and he has only seen him maybe 20 times despite having supervised visitation EVERY weekend. He recently has not seen or even asked about our son since Christmas and has not paid any child support in the 15 months he has been ordered to pay. He has been arrested 4 times that I know of since we separated. 1 was aggravated domestic, the night we separated (Dec. 2016) Then a month later aggravated assault (Jan. 2017) then driving on revoked, dui (Feb. 2017 ) and driving on revoked 4th offense (Nov. 2017). He refuses to give me his address for child support. At this point, with our son being so young, I am afraid it will only confuse him and cause him stress.

A: Child support and visitation are separate issues. A court will not suspend visitation for non-payment of child support. I recommend that you discuss the other issues regarding his inconsistency with an attorney to see what your legal options.
