Q: Can my charges be brought back after being dismissed.

I'm being charged with aggregated assault domestic and aggregated assault the domestic assault was dropped at general sessions. The agg. assault was bond to grand jury but when I got to court both charges were back. I haven't been charged yet.

A: The Attorney General can take any charge and ask for an Indictment at the Grand Jury, whether it was dropped earlier or not. Only exceptions are where jeopardy attached prior to the dismissal or where the Statute of Limitations has run.

Hire a competent attorney now. Do not plead guilty to Domestic Assault of any type. Try to get a Diversion on Assault, Reckless Endangerment, or False Imprisonment. Do the Probation, pay all costs, then get it Dismissed and Expunged. On Assault, the original Indictments must be Nole Prosed by the DA, then agree to an Information.
