Dallas, TX asked in Family Law and Child Custody for Colorado

Q: Can I enroll my son in play therapy without his mother's consent. We have joint decision parenting allocation. There is

nothing in our papers that say I can't or that differentiates between behavior and medical appointments.

A: With joint decision-making, most courts are going to view you unilaterally enrolling your child in play therapy as violating the orders. Even if the orders don't specifically enumerate things like counseling, counseling is still going to be considered a major decision. Most therapists are also going to decline services in a joint decision making scenario unless they have permission from both parents. If your child needs counseling and the other parent disagrees you could potentially file a motion to change decision making on that one issue. You should consider consulting with a child custody attorney.
