Q: Can the states DA issue a "criminal summons" document in lue of an indictment on Tennessee when bound over to Grand Jury
Arrest Date: March 10, 2017. Charge: Domestic Assault / Stop, freeze, frisk. Court Dates: 9x throughout 2017, "victim" never showing in court, DA offering plea of guilty on domestic, stop/freeze/frisk will be dismissed. Defendant: Refused to plea. DA" offered plea of guilty to stop/freeze/frisk, dismiss domestic. Defendant: Refused Plea. Nov 13, 2017: Pretrial hearing (arresting officer on stand to be quest) on stop/freeze/frisk. Judge: Dismissed stop/freeze/frisk, BOUND over DOMESTIC (not aggrivated, domestic only) assault over to Circuit Court for Grand Jury Indictment on next state term, March 2018. Defendant: attended circuit court date sch March 2018, name never called, balif handing over a "Criminal Summons" doc for a resch'd date for July 2018, NEXT Indictment term. Please assist with answering HOW OR IF above is legal or malicious prosecution, statue of limitations, as the charge itself is untrue. TCSD kicked in my front door and bedrm door 12am w/guns drawn at arrest date
