Jacksonville, FL asked in Workers' Compensation for Florida

Q: is it legal for Hawaii workers comp to require Florida doctors to accept hawaii rate schedule/pay scale?

Is it legal for Florida doctors to accept hawaii workers comp pay scale and rate schedule, or further, is it legal for Hawaii workers comp to require Florida doctors to accept hawaii rate schedule/pay scale? My husband is military and we relocated from Hawaii to Florida. My Hawaii claims adjuster is demanding that I find myself a doctor in Florida that’ll accept 1. Hawaii WC fee schedule. 2. Hawaii WC rates. 3. A treatment plan before seeing a Florida doctor. They are also telling me that they’ll close out my claim if I don’t find a doctor in 3 weeks, but it’s proving difficult to find one that’ll accept those terms. Is this legal?

A: The real question is whether the Hawaiian workers compensation policy can limit the amount paid to health care providers in other states. And, in my opinion, yes it can. But you might want to ask your question in Justia › Ask a Lawyer › Hawaii › Workers' Compensation.
