Q: Is my husbands divorce finalized properly?
Petition for divorce was filed Sept 5,2014.
April 12,2017 (Rule to show Cause)
Granted his “Judgement of Divorce” on April 27, 2017. Signed and approved by a judge. We have married since. His ex wife is stating that the divorce was not filed for properly because it two years passed before he filed for a rule for cause. Thus causing abandonment (la.code. Civ.proc.3954)
The original Rule for Cause was filed incorrectly under the wrong form 103 instead of 102, therefor this is why the final rule for cause wasn’t filed till later.
But the judge approved the divorce and obviously issued us a marriage license. The clerk of court stated that the judges signature of the approval is what matters. I just need clarification if this is correct or if we should have filed for a “Motion and order to dismiss Abandoned Suit” and since we didn’t is this divorce legally over since the judge signed off on it?
A:
If his ex has not filed a Petition to Annul the Divorce, then don't worry about it.
If you want more assurance, take the pleadings to a family lawyer to review.
