Philadelphia, PA asked in Real Estate Law and Estate Planning for Pennsylvania

Q: My husband owns our house. We were recently married and the deed is still in his name. He is in ill health and a

friend told us I may have to pay something if my husband passes. Can you tell me what I would be liable to pay? Is there anything that can be done to avoid that ?

A: The question is far more complicated, particularly if your husband has children from earlier relationships. He needs to have a Will, if he is physically and mentally able, and, if the house is to go to you, it should be placed in joint names.

You need to see a lawyer.

I am guessing that your friend was referring to transfer tax or inheritance tax, neither of which applies to transfers between spouses.
