San Jose, CA asked in Child Support for Pennsylvania

Q: Is the plaintiff allowed to sit at home and collect child support without working?

The plaintiff is able bodied with a Bachelor's degree and refuses to work, is there something I can file that would force her to get a job? She lives at home with her family, has no expenses and is using my child support to pay off her student loans.

A: I assume you've raised this issue in support court before. If not, then it's time to do so. Or perhaps your child is older now and the court might view her unemployment differently than before. I suggest that you consult in person with an experienced family law attorney in your area to discuss your options. It's not as easy to argue an earning capacity case in court as it might appear to you.
