Nashville, TN asked in Traffic Tickets and Car Accidents for Tennessee

Q: I got a ticket for failure to show due care, but I didn't cause damage to any vehicle but my own. Why?

I was driving on the interstate when another car swerved at me from the HOV lane. My steering column locked up as I swerved out of their way onto the shoulder, so as a result my car spun off the interstate into a ditch. I didn't hit the other car, nor anyone else. The other driver fled the scene so I have no proof of their offensive driving so it appears I just went off road on their record. I don't understand why I was written a ticket, but the police officer said it was required with no further explanation. Also is there any possibility of having the ticket dropped when I appear for my court date with the circumstances as they are?

A: Possibly. You may want to have an attorney or at least consult one so your rates don't go up. If you were hurt you may have an uninsured motorist claim and would be well advised to consult a member of the Tenn Assn for Justice--they give free consults.
