Q: My wife has abandoned me and left the state. I can divorce her for Abandonment & receive half of her settlement?
My wife left to go back to New Jersey on September 16th of 2017. She took our dog. She had ran before due to anxiety but she moved to mandeville for 3 days before she came back. Then she left for New Jersey in September. In December, she told me she needed time and actually just wanted to go hunting instead of seeing me during the holidays. She visited for our anniversary and then went back to New Jersey. We started arguing about how soon she will be able to come back because I am having back surgery and I need her here. She now will not talk with me in any form of communication. She said she is done after I told her if she can not be here for my surgery then not to come back. She can push appointments and things back to be here for my surgery but she was not willing to. On numerous occasions she has walked away from me and I have put myself into debt for her. Do I have grounds for divorce on abandonment and can I get half of her settlement for abuse and abandonment?
A: We don't have abandonment in Louisiana. But we do have divorce after at least 180 day separation. If you have children it is 365 days separation. However if you have children, you need to hire attorney..before that have been gone 180 days. You mention a settlement without explanation. You need to consult with an attorney because there are just too many unanswered questions.
