Q: Is there a statute of limitations on DUI Charges?

I have a DUI from 2003, can that still be used against me?

A: Yes, for most misdemeanor charges the statute of limitation is one year. However, if your charge is a potential felony DUI, the State would have three years to file (in Nevada).

A: Yes, there is a statute of limitation on a DUI charge. I am not licensed in Colorado but the obvious answer, if it was a misdemeanor charge, is no. However, just because you never received proof that it was not timely filed/charged does not mean it was not.
