A: If the custodial parent opens a child support case through DHS, only child support will be established. DHS will not be able to establish a visitation schedule. In order to obtain visitation, the father will need to petition the court for legitimation. If the father has other minor children that reside in his home, he may also be entitled to a credit on his child support worksheet.

A: Dependents can play a small role in determination of child support, so long as he is legally obligated to support them or they are his children. Ms. Coleman is correct, the father will need to bring a private legitimation action if he wants visitation and custody rights.
