Q: Broke my finger and had neck and back pain from a on the job vehicle accident. No approval or denial after 5 months?

After 5 months my lawyer says my case is still pending and I've yet to receive and salary compensation. I received a letter that was sent to the at fault persons insurance from my employer stating that they have paid me benefits and a lien will be placed on any settlement..that's fine except they haven't actually paid me anything yet. In Illinois how long can a company take to deny or approve workers salary compensation?

A: Five months is longer than it should take for a WC insurer to accept or deny whether a case is compensable, especially a case involving a motor vehicle accident (unless there is a question as to whether the accident arose out and in the course of your employment). The letter sent to the other driver's insurance may have been a form letter letting him or her know the WC insurer or employer is entitled to a lien for anything they pay you or your medical providers, even if they haven't paid anything yet.
