Q: Can I deduct mortgage,fees and upkeep from profit of sale of marital home?
A: The answer to this question will depend on the terms of any agreement you reach with your spouse. If there is no agreement and the Court requires the marital home sold then generally the net profit is what would be subject to distribution though the Court can consider any factors necessary to do equity and justice between the parties. See Florida Statutes, section 61.075.
