Watervliet, NY asked in Estate Planning for New York

Q: My brother, who lived in Maryland, was due to inherit part of our dads estate but he died before disbursement.

Does Maryland's State law allow for my sister-in-law to inherit my brothers portions of the estate? Or does Maryland's State law require my brothers portion to be split between my sister in law and her 3 sons? My brother had a will which had my sister in law as the beneficiary and then her sons as beneficiaries after her death.

A: It goes to your brother's estate. What MD law requires is your sister in law's responsibility as Executor of his estate in MD.
