Q: My ex husband has consistently harassed me for 8+ years. He is often cruel and threatens to take our son.

We have a court ordered joint custody agreement in Georgia. Shortly after he moved to Texas and and has only seen his son once or twice a year, with two exceptions when he asked for longer time. I consistently compromise as I want him to have access to his son and lives so far away. But when I can't agree, because my son has disability issues and doctors or school take precedence, he harassed me. On many occasions he will contact me to harass me on having friends he doesn't approve on, or if I'm in a relationship. He has successfully ended all relationships to the point that I CANNOT date anyone. He has become increasingly abusive and has even kicked his son out and forced me to drive across four states to get him, mid visitation. Now he wants custody. What can I do? I do not believe my son is safe with him and we have therapist paperwork that agrees. He has not adhered to our custody agreement a single time in 9+ years.

A: If your husband has filed a custody case, you need to contact an experienced family law attorney to discuss your case. If he has only seen him 1-2 times per year, it is unlikely the court would grant him custody. You also may be eligible for an increase in support if his income has increased.

A: I agree with Attorney Edwards. You should absolutely consult with a custody attorney immediately to discuss your case. Custody cases are complicated and you should not go at it alone if he is now seeking primary custody.
