Q: 1yr after traffic school/court supervision (speeding), so "no conviction" on record, do I have a "moving violation"?

My daughter completed traffic school, mailed in certificate. Technically I understand that this is "no conviction" on her record but just want to clarify how she should honestly answer the question, "Have you had a moving violation in the past 2 years"

A: The strictest reading of that question would require your daughter to answer yes. If the question asked if she had been convicted of a moving violation, the answer would be no because Supervision is not a conviction. Traffic tickets are a matter of public record, so anyone can look up your daughter's name to see if she received any moving violations in the past 2 years but they would need to know which county and state she received the ticket in. I always counsel on the side of disclosure because if you do not disclose and they find out about it, you now have to also explain why you did not disclose it in the first place which could be worse then just disclosing it up front.

A: The answer is "yes'. She has had one but was not convicted of it. It's confusing because it goes down as an offense (she pled guilty) but not as a conviction.
