Q: Do I have to pay my husband back for this?
My husband and I are about to file for divorce in Louisiana. During our marriage, my husband's mother passed away and she left him some money in her will. He put this money into a new bank account separate from our joint checking account. My name was not on it and I had no way at all to access it in any way. About a year ago he wanted to go after his ex wife for more visitation with his daughter. I told him I wasn't going to spend my money on lawsuit between him and his ex, so he took that money he got from when his mom died and used it to go pay a lawyer. Now he is saying that I'm going to have to pay him back that money he used to pay for the lawyer even though it was his own money in his own separate account that i couldn't touch and was used to hire a lawyer for a fight he got into with his ex wife over a kid that isn't mine that I refused to pay out of the joint account.
A: He used separate funds to pay an expense not in furtherance of the community. No you din't have to pay him back and your attorney should know this.
A: No, that's separate funds used for a purpose that didn't benefit the community. You're not responsible for reimbursement.
