Q: What are my rights in regards to having my car fixed after an accident?
I had an accident 6/4/18 involving the back drivers side quarter panel of my 2007 Sentra. I have full coverage through Acceptance (SR22). I got 2 estimates, 1 was over $1800 and the 2nd $1450. The ins co has given me the run around, I can't speak w my adjuster, it's someone else everytime I call. They had me submit pics and video thru their app and THEIR est was $928, my deductible is $1000. There is no lien on the car. Now they're telling me if the est from the body shop is more than my deductible, the body shop must call them, and then they will issue a check DIRECTLY TO THE BODY SHOP for the balance after I pay my deductible. It is my understanding that since I am the one w the ins, they are to issue a check TO ME. I feel as if they are trying to avoid paying me, as they have been giving me the run around since day 1. Can someone PLEASE explain my rights, as I am being bullied by the ins co I have been w for nearly 3 yrs?
A:
Their obligation is to pay for the damage. Have the body shop get with them. That way if their is a supplemental it's on them. You want to get in the middle, not good.
They may have violated state laws but right now I'm assuming you want your car fixed, etc. If someone else caused the wreck their company should pay and pay 100% You should in that case contact a member ot he Tenn Assn for Justice--they give free consults.
