Q: Condo sellers didnt disclose building & unit water intrusion issues.
I purchased my condo 6 months ago. Two months later, we were hit with significant snow, then heavy rain. Water came through every window header, master closet header, garage, etc. Water remediation was done in my unit through my insurance (HOA ins blamed building neglect). I still have open drywall because no building repairs have been made. Neighbor forwarded me email history over prior 3 years with all unit owners discussing repeated ice damming, water leaks, gutter issues, etc., including my sellers who discuss a water through windows, patio doors, etc. Now that water intrusion has happened, it is apparent sellers hid issues/damage - heavily caulking windows, painting over the caulk, ragged walls, etc. Two inspections didn't catch this. Building needs major repairs & contractors aren't sure they can actually fix the issues - might be major defects to 20 year old building. During closing my real estate attorney emphasized buyer protection, I feel like I have none. What do I do?
A: Go back to your real estate attorney who emphasized buyer protection. Explain the problems you've experienced and that you relied on his or her advice. Then look at him or her expectantly and say, "What do we do now?" I should emphasize this is not your lawyer's fault, but it is his or her opportunity to ride to the rescue. You want to go back to the same lawyer because he or she is already familiar with the circumstances under which you acquired the condo and should already have a copy of the necessary documents.
